Retirement Village Contracts

Selecting a retirement home can be stressful and confusing. The type of residence right you obtain for your dwelling in a retirement village in NSW is important.


Anne can assist you in understanding your rights and responsibilities such as whether or not you have to pay stamp duty on entry; your liability for recurrent charges and reinstatement costs after you leave; whether or not you can appoint your own agent to sell your residence right and set the listing price; whether or not the operator can seek an order requiring you to leave in certain circumstances; ascertaining your share of capital gain or loss (if any) and the calculation of the departure fee.

Commercial and Retail leases are complex documents that must balance the rights of the landlord and tenant and provide for numerous eventualities during the term of the lease.


In NSW retail commercial leasing is covered by the Retail Leases Act 1994. The Act provides for minimum standards which must be followed in commercial leasing relationships.  


Anne can assist Landlords to achieve a Lease that is favourable to them and can assist Tenants to achieve a Lease that is fair. 


Anne can assist Landlords in: 

  • Drafting the commercial or retail lease and preparation of the disclosure statement, if applicable and other relevant documents;
  • Negotiating the terms and conditions of the lease with the Tenant or the Tenant’s  representative;
  • Attending  to review a bank guarantee or to deposit a security bond with the appropriate government department;
  • Ensuring the retail lease is finalised, executed and registered, if required;
  • Prepare and advise in relation to options to renew, assignment or variation of leases

Anne can assist Tenants in: 

  • Reviewing the lease and providing advice on key aspects of the lease;
  • Negotiating the terms of the lease with the Landlord or their representatives;
  • Ensuring understanding of the terms of the lease;
  • Assist with executing and finalising the lease process;
  • Enforcing  the terms and conditions of the lease including an option to renew, rent review, sub-leasing, surrender, transfer, assignment, and variation.
